Elaine S. Bernstein
For the last 19 years, I have represented both employees and employers in all areas of employment and labor law. Eighty percent of my practice is representing employees. The cases range from sexual harassment issues to reinstatement and back pay for violations of a union contract.
I am a 1988 graduate of the University of Dayton School of Law. From 1988 to 1989, I served as a law clerk for Magistrate Judge Michael R. Merz in the Federal District Court in the Southern District of Ohio. Upon entering private practice, I was a partner in the law firm of Jeffrey M. Silverstein & Associates beginning in 1989. Ten years later, I formed my own firm, the Law Offices of Elaine S. Bernstein. Because I realize that a lawsuit can be costly and time consuming, I became actively involved in the alternative dispute resolution aspect of the legal system. I have served as both a mediator and an arbitrator for the Montgomery County Common Pleas Court and mediator for the Federal District Court for the Southern District of Ohio in Dayton. I have also served as a private mediator hired by one or both parties involved in a lawsuit to resolve the dispute either before or after the lawsuit has been filed.
In addition to my law practice, I am an Adjunct Professor at the University of Dayton School of Law teaching civil trial practice skills combined with evidence.
I am past president of the Dayton Women’s Bar Association, a mentoring and networking organization for women attorneys. I also serve as Vice-President of the non-profit Volunteer Lawyers Project, which, through a panel of lawyers, provides legal services in non-criminal matters for those who cannot afford an attorney. I am married and have a married daughter and two grandchildren. I have been a resident of Montgomery County since 1973.
